1. About these terms
These Terms and Conditions govern your use of gonice.site and any purchase you make through it. By browsing the site or placing an order, you agree to these terms. If you do not agree, please do not use the site.
We may update these terms from time to time. The version published here at the moment you place an order is the version that applies to that order.
2. Who we are
This site is operated by Gonice. You can reach us at info@gonice.site with any question about these terms or about an order.
3. Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering you confirm that you meet this requirement and that the payment method you use belongs to you or that you are authorised to use it.
4. Products
We sell a pre-lit artificial Christmas tree supplied as one piece in a ceramic pot, in a 30 inch and a 36 inch size.
We describe our products as accurately as we can, and photograph them faithfully. Colour, foliage density and the finish of the pot vary slightly between individual trees because of how they are made, and screens render colour differently. Small variation of this kind is a characteristic of the product and is not a fault.
Product availability is not guaranteed. We may limit quantities, or withdraw a product, at any time.
5. Prices and payment
Prices are shown in the currency displayed at checkout and may change at any time before you place an order. Taxes and delivery charges are calculated and shown at checkout before you pay.
Payment is taken through Shopify and its payment providers. We do not receive or store your full card details.
Occasionally a product may be listed at an incorrect price because of a technical or human error. Where the error is obvious and could reasonably have been recognised as a mistake, we are not obliged to supply the product at the incorrect price. If this happens we will contact you before dispatch and you may confirm the order at the correct price or cancel it for a full refund.
6. Orders
Placing an order is an offer to buy. Our confirmation email acknowledges that we have received your order; it does not by itself form a contract. The contract is formed when we dispatch the product to you.
We may decline or cancel an order, and will refund you in full if we do. Reasons include the product being unavailable, a pricing error as described above, a payment that cannot be authorised, or an order that appears to be fraudulent or intended for resale.
7. Delivery
We deliver to the destinations offered at checkout. Delivery estimates are estimates, not guarantees, and do not form part of the contract.
Risk in the product passes to you on delivery. If your order arrives damaged, please contact us promptly with your order number and photographs of the product and the packaging.
8. Returns and refunds
Returns are governed by our return policy, which is set out in full on the FAQ page and forms part of these terms. In summary, trees may be returned within 14 days of delivery or by December 24 of the year the order was placed, whichever comes first, and approved returns must be shipped back to us no later than December 24 of that year.
Nothing in these terms or in our return policy limits any statutory right you have that cannot lawfully be excluded, including rights relating to goods that are faulty, damaged or not as described.
9. Using the product safely
Our trees contain integrated electric lighting. Please follow the instructions supplied with the product. Do not use a tree with damaged wiring or a damaged plug, do not place it near an open flame or a direct heat source, and unplug it when the room is unattended or when you are away.
The product is intended for indoor domestic decorative use only.
10. Intellectual property
All content on this site, including text, photographs, illustrations, logos and page design, belongs to Gonice or to our licensors and is protected by intellectual property law. You may view and print pages for your own personal use. You may not reproduce, republish or use our content commercially without our written permission.
11. Acceptable use
You agree not to use the site in any way that is unlawful, that interferes with its operation or security, or that attempts to gain unauthorised access to it. You agree not to extract data from the site by automated means without our permission.
12. Links to other sites
The site may link to websites we do not control. We provide those links for convenience and we are not responsible for their content, their products or their privacy practices.
13. Disclaimers
The site is provided on an as available basis. We do not warrant that it will be uninterrupted, error free, or free of harmful components. To the fullest extent permitted by law, we exclude implied warranties that are not expressly stated in these terms.
This clause does not affect your statutory rights in relation to the products you buy from us.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of the site or from any product bought through it, including loss of profit, loss of data, or loss of opportunity.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded.
15. Privacy
Our handling of your personal information is described in our Privacy Policy, which forms part of these terms.
16. Governing law
These terms are governed by the laws of the State of California, United States, and you and we submit to the courts of that state, without affecting any right you have to bring a claim in the courts of the country where you live where local law gives you that right.
